Terms of Service
These Terms of Service ("Terms") are an agreement between you and Metamorphosis Consulting, LLC, doing business as Txt4RSVP ("Txt4RSVP," "we," "us" or "our") and govern your use of txt4rsvp.com and the Txt4RSVP RSVP-by-text service (the "Service"). By using the Service, including by texting an event code to Txt4RSVP, you agree to these Terms, our SMS Terms and our Privacy Policy.
1. The Service
Txt4RSVP lets event hosts ("Hosts") create events and RSVP codes, and lets invited guests ("Guests") RSVP by sending a text message. Hosts can view RSVPs and headcounts in an online dashboard. Txt4RSVP may also be offered to Hosts through approved partners such as event planners, venues and organizations ("Partners"). The Service is currently available in the United States.
2. Guests
- By texting an event code, you agree to receive automated text messages from Txt4RSVP about your RSVP, as described in the SMS Terms. Message and data rates may apply. Reply STOP to opt out or HELP for help.
- You agree to provide accurate RSVP information and to text from a phone number you are authorized to use.
- Your RSVP is shared with the event's Host. The Host, not Txt4RSVP, is responsible for the event itself, including its details, changes and cancellations.
3. Host accounts
- You must be at least 18 years old and able to form a binding contract to create a Host account.
- You are responsible for the accuracy of your account and event information, for keeping your password secure, and for all activity under your account.
- If you create an account on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
4. Messaging rules for Hosts
Txt4RSVP uses a shared, carrier-registered phone number for all events, so every Host must help keep it in good standing. You agree that you will:
- Share your event code only with people you have invited or who may reasonably want to RSVP to your event, and display the RSVP disclosures we provide (including "Msg & data rates may apply" and "Reply STOP to opt out") wherever you publish your code, when practical
- Not use the Service to send marketing, promotional or unsolicited messages, or to message anyone who has not texted your event code
- Not include links, phone numbers, or content in event names or messages that is false, misleading, hateful, harassing, sexually explicit, violent, illegal, or related to prohibited categories under wireless carrier guidelines (including cannabis, firearms, gambling, high-risk financial services and debt collection)
- Not attempt to collect sensitive information (such as financial account numbers, Social Security numbers or health information) through the Service
- Comply with all applicable laws, including the Telephone Consumer Protection Act and state telemarketing and privacy laws
We may review, edit, block or remove event content, suspend events or accounts, and stop sending messages if we believe these rules have been violated or a carrier requires it.
5. Fees and payment
- Some features require payment. Prices are shown before you buy and are charged through our payment processor, Stripe.
- Single-event purchases are one-time charges. Annual plans renew automatically unless you cancel before the renewal date; you can cancel at any time from your account, and cancellation takes effect at the end of the current term.
- Because RSVP messages are sent as soon as an event goes live, fees are generally non-refundable once an event has received RSVPs. If something goes wrong, contact support@txt4rsvp.com and we'll make it right where we reasonably can.
- If you purchased through a Partner, the Partner's pricing and refund terms apply to that purchase, and the Partner may be your first point of contact for support.
6. Your data
Hosts own the event information they provide and the RSVP data collected for their events, and grant Txt4RSVP a limited license to use it to provide the Service. Hosts may use Guest RSVP information only to plan and manage their event. Guest RSVP data is deleted within 90 days after the event date, so please export anything you need before then. See our Privacy Policy.
7. Our intellectual property
The Service, including its software, design and the Txt4RSVP name and logo, is owned by Txt4RSVP and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service as intended under these Terms. You may not copy, reverse engineer, resell (except as an approved Partner) or interfere with the Service.
8. Availability and changes
We work to keep the Service reliable, but text message delivery depends on wireless carriers and other third parties outside our control. Wireless carriers are not liable for delayed or undelivered messages. We may change, suspend or discontinue features with reasonable notice where practical.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, TXT4RSVP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT EVERY MESSAGE WILL BE DELIVERED OR THAT HEADCOUNTS WILL BE COMPLETE OR ACCURATE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TXT4RSVP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.
11. Indemnification
Hosts and Partners agree to defend and indemnify Txt4RSVP against claims, fines and costs arising from their event content, their use of the Service, or their violation of these Terms or applicable law, including carrier fines caused by prohibited content.
12. Termination
You may stop using the Service at any time. Guests can reply STOP; Hosts can close their account. We may suspend or terminate access if you violate these Terms or if needed to protect the Service, other users or our carrier standing.
13. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Tuscarawas County, Ohio, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will notify Hosts by email or in the dashboard before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
